1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Cigar Hustler website, products, and services operated by Cigar Hustler ("Company," "we," "us," or "our"), located at 829 Deltona Blvd, Deltona, FL 32725. By accessing the site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the site.

2. Website Usage & Account Terms

You agree to use the site only for lawful purposes and not to interfere with its operation, attempt unauthorized access, or use it in any way that could damage or impair the service. To purchase products or join the Cigar Club, you must create an account and provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Age Restriction (21+) & Tobacco Products

You must be at least 21 years of age to access this site, create an account, or purchase any product. By using the site you represent and warrant that you are 21 or older. We sell tobacco and tobacco-related products and do not sell to minors under any circumstances.

All orders are subject to age verification. We may require valid government-issued photo identification at the time of purchase and at delivery, and the carrier may require an adult signature (21+). We reserve the right to cancel any order that cannot be age-verified.

4. Products, Orders & Liability

We try to describe and display products accurately, but we do not warrant that product descriptions, images, pricing, or other content are error-free, complete, or current. Cigars are natural, hand-made agricultural products and may vary in appearance, color, and construction.

All orders are offers to purchase and are subject to acceptance and product availability. We may, at our discretion, limit quantities, refuse, or cancel any order, including after an order has been placed. To the fullest extent permitted by law, products are provided "as is," and our total liability arising out of any product or order will not exceed the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages.

5. Payment Terms

Prices are in U.S. dollars and are subject to change. Applicable sales tax (including Florida sales tax where required) and shipping charges are calculated at checkout. By submitting an order you authorize us and our payment processor, Authorize.Net, to charge your selected payment method for the total order amount.

You represent that you are authorized to use the payment method provided. We do not store full payment card numbers; card data is handled by our PCI-compliant payment processor. Orders are not confirmed until payment is authorized.

6. Shipping, Refunds & Returns

Title and risk of loss pass to you upon our delivery of the products to the carrier. Estimated delivery times are not guaranteed.

Due to the nature of tobacco products and applicable law, returns are limited. If your order arrives damaged, defective, or incorrect, contact us within seven (7) days of delivery and we will work with you to repair, replace, or refund the affected items at our discretion. Refunds, when issued, are made to the original payment method. Certain items may be non-returnable. Shipping charges are generally non-refundable except where an order was our error.

7. Cigar Club Subscriptions

Cigar Club memberships renew automatically on a monthly or annual basis until cancelled. By subscribing, you authorize recurring charges to your payment method at the then-current rate for your tier. You may cancel at any time; cancellation stops future renewals but does not retroactively refund amounts already billed, except as required by law.

8. Swag Vault Rewards Program

Purchases may earn reward points that can be redeemed in the Swag Vault. The rewards program is governed by separate, detailed terms, including how points are earned, redeemed, and expire. Please review the Swag Vault Rewards Terms & Conditions, which are incorporated into these Terms by reference.

9. SMS / Text Messaging Terms

By opting in to our text messaging program, you consent to receive recurring automated marketing and transactional text messages (such as order updates and promotions) from or on behalf of Cigar Hustler at the mobile number you provide, sent via our messaging provider, Twilio. Consent is not a condition of any purchase.

Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can reply HELP for help. We may also email or call you regarding your account and orders. See our Privacy Policy for how we handle the information you provide.

10. Intellectual Property

All content on this site — including text, graphics, logos, images, and software — is the property of Cigar Hustler or its licensors and is protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

11. Changes to These Terms

We may update these Terms at any time. Changes are effective when posted, and your continued use of the site after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the site will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
